Article 1 - Definitions<\/h3>\n

In these terms and conditions, the following definitions shall apply:<\/p>\n

    \n
  • Entrepreneur:<\/strong> Rob v\/d Heuvel Cars, also trading as Heuvelparts and Heuvelparts.com.<\/li>\n
  • Buyer\/Customer:<\/strong> Any natural or legal person who enters into an agreement with the entrepreneur.<\/li>\n
  • Consumer:<\/strong> Customer not acting from profession or business.<\/li>\n
  • Products:<\/strong> auto parts, accessories, styling items, assembly parts and vehicles.<\/li>\n
  • Services:<\/strong> tuning, assembly, diagnosis, maintenance, software modifications and other work.<\/li>\n
  • Webshop:<\/strong> all digital services through Heuvelparts.com.<\/li>\n
  • Agreement:<\/strong> any purchase, order, assignment or transaction.<\/li>\n
  • Vehicle:<\/strong> any motor vehicle, car, van or camper.<\/li>\n
  • Specially ordered parts:<\/strong> parts that are not standard in stock and are ordered by customer request.<\/li>\n <\/ul>\n\n

    Article 2 - Applicability.<\/h3>\n
      \n
    • These general terms and conditions apply to all offers, sales, services, deliveries and agreements of the entrepreneur.<\/li>\n
    • Variations are valid only if agreed in writing.<\/li>\n
    • If any provision is found to be invalid, the remaining provisions shall remain in full force and effect.<\/li>\n <\/ul>\n\n

      Article 3 - Offers & Prices.<\/h3>\n
        \n
      • All prices are inclusive of VAT for consumers and exclusive of VAT for business customers unless otherwise stated.<\/li>\n
      • Typographical errors and price variations are reserved; no rights can be derived from these.<\/li>\n
      • Prices for vehicles may change due to market conditions.<\/li>\n
      • Offers are valid while supplies last.<\/li>\n <\/ul>\n\n

        Article 4 - Orders in the Webshop<\/h3>\n
          \n
        • After placing an order, the customer will receive an email confirmation.<\/li>\n
        • The entrepreneur may refuse an order if fraud, incorrect information or outstanding debts are suspected.<\/li>\n
        • Specially ordered parts should always be paid in full in advance.<\/li>\n <\/ul>\n\n

          Article 5 - Delivery & Transportation<\/h3>\n
            \n
          • Delivery dates are indicative and not deadlines.<\/li>\n
          • The risk of damage or loss passes to the customer upon delivery to the specified address.<\/li>\n
          • If the customer refuses a shipment, additional charges may apply.<\/li>\n
          • Deliveries are made via PostNL, DHL, DPD, courier services or our own transportation.<\/li>\n <\/ul>\n\n

            Article 6 - Right of withdrawal (Consumers).<\/h3>\n

            Consumers have a 14-day cooling-off period unless excluded as noted below.<\/p>\n

            Return conditions:<\/strong><\/p>\n

              \n
            • The product must be undamaged, unused and complete.<\/li>\n
            • Return costs are at the customer's expense and risk.<\/li>\n
            • Refunds will be made within 14 days of receipt of the returned product.<\/li>\n <\/ul>\n\n

              Exclusion of the right of withdrawal<\/h4>\n

              The right of withdrawal is excluded for:<\/p>\n

                \n
              • Specially ordered parts<\/li>\n
              • Electronic components (ECUs, sensors, airbag modules, electrical units)<\/li>\n
              • Software, tuning files and digital products<\/li>\n
              • Parts that are no longer saleable due to assembly<\/li>\n
              • Products that have become defective due to misuse<\/li>\n <\/ul>\n\n

                Article 7 - Assembly, Tuning & Workshop Conditions.<\/h3>\n
                  \n
                • The customer is responsible for providing correct vehicle information.<\/li>\n
                • The entrepreneur is not liable for damages caused by uneven or incorrect assembly by third parties.<\/li>\n
                • Tuning can void manufacturer's warranty; this risk lies entirely with the customer.<\/li>\n
                • Power gains in tuning are always indicative.<\/li>\n
                • Storage fees (\u20ac15 per day) may be charged if a vehicle is not picked up within 48 hours of completion notification.<\/li>\n <\/ul>\n\n

                  Article 8 - Warranty<\/h3>\n
                    \n
                  • New parts have a standard 12-month warranty unless otherwise stated.<\/li>\n
                  • Consumables such as brake pads, oil, filters and paint are not covered under warranty.<\/li>\n
                  • Warranty is void in case of misuse, damage by tuning or assembly by unauthorized persons.<\/li>\n
                  • Vehicles are sold with the warranty as agreed upon in writing.<\/li>\n <\/ul>\n\n

                    Article 9 - Liability<\/h3>\n
                      \n
                    • Entrepreneur is not liable for consequential damages, loss of profits or depreciation.<\/li>\n
                    • Liability is always limited to the invoice amount of the product or service.<\/li>\n
                    • The customer is responsible for correct assembly and use of parts.<\/li>\n
                    • With tuning, the customer is responsible for technical condition and risks of engine and driveline damage.<\/li>\n <\/ul>\n\n

                      Article 10 - Purchase of Vehicles.<\/h3>\n
                        \n
                      • The customer must provide accurate information about the vehicle.<\/li>\n
                      • The customer guarantees that the vehicle is free of repossessions, theft endorsements and financing.<\/li>\n
                      • The customer provides a valid ID and registration code.<\/li>\n
                      • In case of hidden legal problems, the client is liable for all costs and damages.<\/li>\n <\/ul>\n\n

                        Article 11 - Sale of Vehicles<\/h3>\n
                          \n
                        • Vehicles are sold in their condition.<\/li>\n
                        • Known defects are reported to the extent possible.<\/li>\n
                        • A test drive is possible after consultation; damage during test drive may be recovered from the driver.<\/li>\n
                        • Warranty on used vehicles applies only if agreed in writing.<\/li>\n <\/ul>\n\n

                          Article 12 - Payment<\/h3>\n
                            \n
                          • Payment shall be made prior to delivery or performance of services, unless otherwise agreed upon.<\/li>\n
                          • Webshop orders are paid in advance via payment methods offered.<\/li>\n
                          • Late payment may incur statutory interest and collection costs.<\/li>\n <\/ul>\n\n

                            Article 13 - Retention of title.<\/h3>\n
                              \n
                            • All delivered products remain the property of the entrepreneur until full payment is received.<\/li>\n
                            • The customer may not sell or pledge goods until they are paid in full.<\/li>\n <\/ul>\n\n

                              Article 14 - Force majeure<\/h3>\n
                                \n
                              • The entrepreneur is not liable for damages due to circumstances beyond his control, such as strikes, illness, breakdowns or transportation problems.<\/li>\n
                              • In cases of force majeure, the contract may be postponed or rescinded.<\/li>\n <\/ul>\n\n

                                Article 15 - Complaint procedure<\/h3>\n
                                  \n
                                • Complaints must be reported in writing in a timely manner.<\/li>\n
                                • The business owner responds with a substantive response within 14 days.<\/li>\n
                                • If no resolution is reached, the customer may apply to a dispute committee or court.<\/li>\n <\/ul>\n\n

                                  Article 16 - Applicable law<\/h3>\n

                                  All agreements are exclusively governed by Dutch law.
